Terms of Service — Lodgy.co

• Management of bookings and rates for accommodation units
• Synchronization with OTA channels (Booking.com, Airbnb, Expedia) through Channex
• Automated communication with guests (email, SMS, OTA inbox)
• eVisitor guest registrations
• Guest invoicing

• The Operator is obliged to provide accurate information during registration
• The Operator is responsible for the security of their access credentials (password, 2FA)
• The Operator guarantees that they have the legal right to manage the accommodations they enter into the system
• Sharing accounts with third parties is strictly prohibited

• Subscription is charged monthly/annually according to the selected plan
• Payment is made in advance; failure to pay within 7 days results in account suspension
• Lodgy may modify prices with a 30-day prior notice
• Refunds: not possible for an already utilized subscription period

• Comply with all laws related to providing accommodation services in their jurisdiction
• Hold valid permits for providing accommodation (categorization, trade/craft registry, or limited liability company)
• Register all guests in the eVisitor system within legal deadlines (Republic of Croatia: within 24 hours of arrival)
• Invoice guests in accordance with tax regulations
• Keep personal data of guests in compliance with GDPR (Lodgy acts solely as a Data PROCESSOR)
• Provide their own Channex, Resend, and Twilio API keys if they use their own personal corporate accounts

• We will make every effort to maintain Service availability at 99.5% of the time (this does not constitute an SLA guarantee)
• Lodgy is not liable for:
  • Downtime or outages of OTA channels (Booking.com, Airbnb, Expedia)
  • Downtime or outages of third-party services (Channex, Resend, Twilio, Gemini, eVisitor)
  • Lost profits or unrealized bookings
  • Operator errors (incorrectly set prices, improper restrictions)
• Maximum liability of Lodgy = the subscription amount paid for the current month

• The code, design, documentation, and branding of Lodgy are the property of BOP, obrt za izradu web stranica, vl. Kornelia Šokota (or Lodgy.co)
• The Operator retains ownership over their business data (bookings, prices, guest data) and can export them in JSON format at any time

• The Operator can terminate the agreement at any time through their account settings
• Upon termination, data is stored for 90 days (grace period for return) and then permanently deleted
• The Operator can request an immediate export of all data before deletion
• Lodgy can terminate the agreement with a 30-day prior notice; in case of a breach of terms — immediately
   

• Attempting unauthorized access to other users’ accounts
• Automated scraping / API abuse
• Sending spam messages to guests
• Using the service for illegal accommodation (without permits or proper categorization)
• Reverse engineering or decompiling the system code

• Disputes shall primarily be resolved amicably via: [email protected]
• Competent court: Commercial Court in Rijeka (Trgovački sud u Rijeci)
• Governing law: Republic of Croatia
